These Terms of Service (“Terms”) govern your access to and use of the AxisClear website, platform, services, and digital products (the “Platform”) operated by Heirs of Joy and Grace LLC (“HJG LLC,” “we,” “our,” or “us”).
By accessing or using the Platform, purchasing services, or creating an account, you agree to these Terms.
Description of Services
AxisClear provides structured assessments, organizational frameworks, informational reports, and decision-support tools designed to help individuals and families organize information and evaluate possible next steps.
AxisClear is a planning and decision-support platform. The Platform does not provide legal advice, financial advice, medical advice, mental health counseling, academic admissions counseling, employment placement services, or other licensed professional services.
All decisions and actions taken based on information provided through the Platform remain the responsibility of the user.
User Responsibility for Decisions
AxisClear materials, frameworks, assessments, and reports are intended to assist users in organizing information and evaluating options.
Users are solely responsible for decisions made, actions taken, and outcomes resulting from use of the Platform.
Heirs of Joy and Grace LLC is not responsible for outcomes resulting from decisions made by users.
Accuracy of Information Provided
Users are responsible for ensuring that information submitted through assessments, surveys, intake forms, questionnaires, or communications is accurate and complete.
AxisClear relies on the information provided by users when generating reports or planning materials. We are not responsible for outcomes resulting from inaccurate, incomplete, or misleading information submitted by users.
Intellectual Property Ownership
All content, reports, frameworks, methodologies, assessments, text, graphics, branding, software, and platform design available through the Platform are the intellectual property of Heirs of Joy and Grace LLC and are protected by copyright, trademark, and intellectual property laws.
Use of the Platform does not transfer ownership rights to users.
Limited License
Upon purchase or access, AxisClear grants users a limited, non-exclusive, non-transferable license to access and use Platform materials solely for personal, non-commercial purposes.
This license does not grant ownership of any intellectual property.
Protection of Methodology and Framework Structure
AxisClear includes proprietary frameworks, assessments, organizational systems, analysis methodologies, and decision models developed by Heirs of Joy and Grace LLC.
The structure, sequence, organization, and conceptual framework of the AxisClear system, including the assessment process and planning methodology, constitute proprietary intellectual property.
Users may not replicate, reproduce, reverse engineer, adapt, recreate, or develop competing products or services based on the AxisClear methodology or its structural organization.
Prohibited Use
Users may not:
Copy or reproduce Platform materials
Distribute or resell Platform content
Recreate or rebrand AxisClear products or frameworks
Use Platform materials in commercial or competitive services
Share or transfer accounts without authorization
Interfere with Platform security or functionality
Upload unlawful, harmful, or abusive content
Violation of these Terms may result in removal of content, suspension of accounts, or termination of access.
Accounts and Memberships
Certain features of the Platform may require account registration.
Users are responsible for maintaining the confidentiality of login credentials and for all activity occurring under their account.
Accounts may not be shared, transferred, or resold without written permission.
We reserve the right to suspend or terminate accounts that violate these Terms.
Service Initiation
Accessing or submitting the AxisClear assessment or intake questionnaire constitutes the commencement of services and access to proprietary AxisClear methodologies.
Once the assessment has been accessed or submitted, services are considered initiated.
Refund eligibility is governed by the AxisClear Refund Policy.
Delivery Timeline
Blueprint delivery timelines begin once all required assessments and intake information have been submitted.
Failure to submit required intake information may delay service delivery.
Purchases and Digital Services
AxisClear products and services are delivered digitally.
Due to the proprietary and customized nature of the services, purchases are subject to the AxisClear Refund Policy.
Dispute Window
Any concerns regarding completed services must be submitted within 14 days of delivery of the final blueprint or report.
Failure to notify us within this timeframe will be considered acceptance of the delivered materials.
Payment Disputes and Chargebacks
Users agree to contact AxisClear directly to resolve concerns before initiating a payment dispute or chargeback with their financial institution.
Unauthorized chargebacks for services already initiated or delivered may result in suspension of Platform access and recovery of administrative costs incurred in resolving the dispute.
No Guarantee of Outcomes
AxisClear provides informational frameworks and decision-support tools.
Results will vary based on individual circumstances, effort, economic conditions, and external factors.
We do not guarantee employment, promotions, admissions, enlistment, financial outcomes, or other specific results.
Community Features and User Content
The Platform may include community features such as discussions or group interactions.
Users are responsible for content they post and must engage respectfully.
We reserve the right to remove content, restrict participation, or terminate accounts that violate these Terms.
Third-Party Services
The Platform may rely on third-party providers including website hosting services, payment processors, analytics providers, and survey tools.
We are not responsible for the policies or practices of third-party services.
Platform Availability
We do not guarantee uninterrupted access to the Platform and may modify, suspend, or discontinue services or features at any time.
Limitation of Liability
To the fullest extent permitted by law, AxisClear and Heirs of Joy and Grace LLC shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of the Platform or reliance on information provided.
Use of the Platform is at your own risk.
Force Majeure
Heirs of Joy and Grace LLC shall not be liable for delays or interruptions caused by events beyond our reasonable control, including natural disasters, power outages, internet failures, platform outages, acts of government, or other unforeseen circumstances.
Dispute Resolution
Any dispute, claim, or controversy arising from the use of the Platform shall be resolved through binding arbitration rather than court proceedings, except where prohibited by law.
Arbitration shall be conducted on an individual basis and not as part of a class or representative action.
Changes to Terms
We may update these Terms from time to time. Updates will be posted on this page with a revised effective date. Continued use of the Platform after updates constitutes acceptance of the revised Terms.
Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the jurisdiction in which Heirs of Joy and Grace LLC operates.
